1. Agreement to Terms
Please read these Terms of Use ("Terms") carefully before using the Parcel Map mobile application and the parcelmap.app website (together, the "Service"). The Service is operated by Individual Entrepreneur Uri Nemirovsky, identification number 300413461, registered in Tbilisi, Georgia ("Parcel Map", "we", "us", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, please do not use the Service.
2. Subscriptions
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring basis ("Billing Cycle"). Billing Cycles are either monthly or annual, depending on the subscription plan you select. At the end of each Billing Cycle, your Subscription automatically renews under the same conditions unless you cancel it. If you violate these Terms, we may cancel your Subscription.
Payment processing depends on where you purchase your Subscription:
- In-app purchases. Subscriptions purchased inside the iOS app are processed by Apple through your App Store account. You can manage or cancel them at any time in your device settings (Settings → your name → Subscriptions).
- Web purchases. Subscriptions purchased on our website are processed by our merchant of record, Paddle.com Market Ltd ("Paddle"). Paddle acts as an authorized reseller of the Service and handles payment, billing, and applicable taxes. You can cancel a web Subscription using the link in your Paddle receipt email or by contacting us at hello@parcelmap.app.
We receive a record of completed transactions; an active Subscription is identified based on the transaction date and type.
3. Free Trial
We may, at our sole discretion, offer a Subscription with a free trial for a limited period of time — for example, a 7-day free trial ("Free Trial").
You may be required to enter your payment details to start a Free Trial. No payment is collected until the Free Trial ends. Unless you cancel before the end of the Free Trial, the subscription fee is charged automatically on the last day of the Free Trial period. For Subscriptions billed through the App Store, cancel at least 24 hours before the trial ends to avoid being charged.
We reserve the right to (i) change the conditions of a Free Trial offer or (ii) withdraw a Free Trial offer at any time.
4. Subscription Fee Changes
We may change Subscription fees at any time. A fee change becomes effective at the end of the then-current Billing Cycle. We will give you reasonable advance notice of any fee change so you can cancel your Subscription before the change takes effect. Your continued use of the Service after a fee change becomes effective constitutes your agreement to pay the changed amount.
5. Refunds
Refunds are handled in accordance with our Refund Policy. In short: we offer refunds within 14 days of purchase if the Subscription has not been substantially used. Purchases made through the App Store are subject to Apple's refund process, and we are not able to issue refunds for App Store transactions directly. Nothing in these Terms limits any refund rights you may have under applicable law.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Parcel Map and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and other countries. Our trademarks may not be used in connection with any product or service without our prior written consent.
7. Links to Other Websites
Our Service may contain links to third-party websites or services that are not owned or controlled by Parcel Map.
Parcel Map has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We strongly advise you to read the terms and privacy policy of any third-party website or service that you visit.
8. Limitation of Liability
To the maximum extent permitted by law, Parcel Map and its employees and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits or other intangible losses, resulting from (i) your access to or use of the Service, or inability to access or use it; (ii) any conduct or content of any third party; or (iii) any content obtained from the Service.
9. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Property data available through the Service is compiled from public records and third-party sources. We do not guarantee the accuracy, completeness, or timeliness of this data, and it should not be relied upon as a substitute for a professional survey, title search, or legal advice.
Parcel Map and its licensors do not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your expectations.
10. Governing Law
These Terms are governed by the laws of Georgia (the country in which the Service operator is registered), without regard to conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding the Service and supersede any prior agreements we might have had regarding the Service.
11. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the Service.
